Which side of the fence is mine?

There’s a common misconception that you own the fence on the left side of your property as you look at it from the street. But it really is a misconception so if you're unsure about whether you're responsible for a fence, there are several ways to find out.

1. Firstly, you can examine the property title plan and registry details, also known as the office copy, to determine ownership. Ownership is indicated by a symbol that looks like a ’T’ marked on one or both sides of a boundary. If the ’T’ is marked on your side, then you own the fence. When the ’T’ is marked on both sides of the boundary then you and your neighbour have joint ownership and responsibility for the fence.


2. If this information is not available on the title plan, you can check the fence's position to see which side the smoother, more visually appealing side faces (the "good" side) as this usually belongs to the non-owner's garden and the fence posts are usually on the owner's side.

3. Thirdly, consult the conveyancer you used when purchasing the property to establish ownership.

4. Finally, if none of the above methods work, ownership typically falls to the person who has maintained the fence in the past, meaning that if you've repaired it before, you'll probably be responsible for it in the future.


How high can my fence be?

Legally in the UK the height of your fence can go up to 2 metres or 6ft 6inches. Local councils will allow you up to 4ft of fencing meaning that compared to the fence height at the back of the house it will be 2ft lower.


Do I need planning permission to erect a fence?

There are times when planning permission to erect a fence is required and one of them is it your fence fronts a road, footpath or public highway and it’s more than 1 metre in height.

For a fence that doesn’t front onto a road, planning permission is needed for anything over 2 metres tall and this includes a trellis topper.


For listed building, if you’re wanting to build a fence around it then you will almost definitely need to get planning permission regardless of the fence height and also listed building consent.

If your property is in a conservation area then you will also need planning permission to demolish a fence if it’s more than one metre in height and fronts onto a road or if it’s greater than two metres in height elsewhere.



How often do you need to paint a garden fence?

As a general rule of thumb, you should paint or stain your fence once every two years and good practise to replace your fence panels every five to ten years. It's also recommended that garden fences are treated with a product that contains UV and moisture protection for longer durability against weather conditions. And in areas that get a lot of rain or snow some kind of waterproofing treatment is advised if you want to protect against rot and mould.


How much will a new fence cost?

The question of cost can't be answered until the type and design of your fence installation has been decided because these two factors will have a significant impact on the overall cost. In general, the cost of your fence will depend on:

  • The overall length and height
  • The type of material used
  • The gradient of the ground it is to be installed on
  • The complexity of the style and design
  • The distance between the posts

How long will it take to install a new fence?

The size of the fencing to be installed along with factors like if existing fencing needs removing, the underlying site conditions, if the ground is sloped and the choice of materials and style can all affect how long the project will take. But on average, the actual installation process can take anywhere between one and four days and should occuer over consecutive days.
